Terms of Service

Welcome to Valéne. These Terms of Service ("Terms") govern your access to and use of the Valéne platform, including our website, mobile application, and all related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.

Valéne is a peer-to-peer marketplace that enables users to rent and lend fashion items. We act as an intermediary to facilitate transactions between Renters and Lenders. Valéne does not own, control, or inspect the items listed on the Platform.

To use Valéne, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Complete identity verification as required by our platform
• Provide accurate, complete, and current registration information
• Not have been previously suspended or removed from the Platform

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify Valéne of any unauthorized use of your account.

Each user may maintain only one active account. Accounts are non-transferable. We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines.

When you submit a rental request, you agree to pay the total rental amount if the Lender accepts. You are responsible for returning items on time and in the same condition they were received.

Late returns will incur a fee equal to the daily rental rate for each additional day. If an item is not returned within 7 days of the agreed return date, it may be treated as lost.

By listing an item, you represent and warrant that you own the item (or have authority to lend it), the item is authentic, and the listing description accurately represents the item's condition, size, and appearance.

Lenders are responsible for ensuring items are clean, in the stated condition, and available during the listed dates. Repeated cancellations or inaccurate listings may result in account restrictions.

Valéne charges the following fees:

• Service fee (Renter): A percentage-based fee added to each rental, displayed at checkout
• Platform commission (Lender): A percentage deducted from the rental price before payout
• Damage protection fee: Included in all rentals to cover accidental damage

Lender payouts are processed within 48 hours of rental completion and deposited into the Valéne Wallet. Withdrawal to an external bank account typically takes 1–3 business days.

All rentals include built-in damage protection. In the event of accidental damage, either party may submit a claim through the Platform with photographic evidence. Valéne will review claims and facilitate resolution within 48 hours.

In cases of significant damage or loss, the Renter may be charged up to the item's full retail replacement value. Fraudulent claims or intentional damage may result in account termination and legal action.

• 48+ hours before start: Full refund to the Renter
• 24–48 hours before start: 50% refund to the Renter
• Less than 24 hours: No refund (unless extenuating circumstances apply)
• Lender cancellation: Permitted at any time, but repeated cancellations will affect your rating and may result in account restrictions

Users agree not to:

• List counterfeit, stolen, or misrepresented items
• Use the Platform for any illegal purpose
• Harass, threaten, or abuse other users
• Attempt to circumvent the Platform's payment system
• Create multiple accounts or impersonate another user
• Scrape, copy, or redistribute Platform content without permission

The Valéne name, logo, and all Platform content are the property of Valéne and protected by intellectual property laws. Users retain ownership of content they upload but grant Valéne a non-exclusive, worldwide license to use, display, and distribute such content in connection with the Platform.

Valéne acts as a marketplace intermediary and is not a party to transactions between Renters and Lenders. To the maximum extent permitted by law, Valéne shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount of fees paid by you to Valéne in the 12 months preceding the claim.

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through Settings. Upon termination, all active listings are removed. Any pending payouts will be processed, and wallet balance can be withdrawn before deletion.

We may update these Terms from time to time. Material changes will be communicated via email and in-app notification at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
